These Terms & Conditions (“Terms”) govern your access to and use of socialkindacademy.com (the “Website”), operated by SocialKind Academy (“we,” “us,” “our”), including any courses, programmes, and products purchased through it. By accessing the Website or making a purchase, you agree to be bound by these Terms. If you do not agree, please do not use the Website.

1. Eligibility

You must be at least 18 years old to create an account or make a purchase on this Website. If you are under 18, you may use the Website only under the supervision of a parent or legal guardian who agrees to these Terms on your behalf.

2. Account Registration

To access certain courses, you may need to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. 3. Our Courses and Programs

We offer online courses and coaching programmes related to Sales, Marketing, Website Development, Meta Ads, Graphics Design, Video Editing, SEO & AI. Course content, structure, pricing, and availability may be updated, modified, or discontinued at our discretion, and we will make reasonable efforts to inform enrolled students of any material changes.

4. Course Access

Unless otherwise stated for a specific course or programme, purchased courses come with lifetime access, meaning you may access the course content for as long as SocialKind Academy continues to offer that course and operate the Website. In the rare event that we discontinue a course or the Website itself, we will make reasonable efforts to notify you in advance and, where feasible, provide alternative access arrangements.

Access is granted for your personal, individual use only. Sharing your login credentials, or the course content itself, with any third party is strictly prohibited (see Section 8).

5. Physical Products

From time to time, we may also offer physical products such as books, learning kits, or merchandise (“Physical Products”) for purchase through the Website, in addition to our digital courses. For Physical Products:

Product images are for illustrative purposes; actual products may vary slightly in appearance or packaging.
Estimated delivery timelines will be communicated at the time of purchase or shipping confirmation, and may vary based on your location and courier availability.
Ownership and risk of loss for Physical Products passes to you upon delivery.
Any issues with damaged, defective, or incorrect items must be reported to us within a reasonable time of delivery, as detailed in our Refund and Returns Policy.

6. Payments and Pricing

All prices on the Website are listed in Indian Rupees (INR) and are inclusive/exclusive of applicable taxes as indicated at checkout. We accept payment through the following methods:
Razorpay — secure online payment via card, net-banking, or UPI through our payment gateway partner
Manual UPI transfer — direct UPI payment to our official UPI ID, verified using your transaction reference/screenshot
Cash payment — accepted in person or at offline events, where applicable
We reserve the right to change our pricing at any time; however, changes will not affect orders already confirmed and paid for. Your access to a course, programme, or product is confirmed only after successful payment verification.

7. Refunds and Cancellations

Refund and cancellation requests are handled in accordance with our Refund and Returns Policy, which forms part of these Terms. We do not levy any cancellation charges on you for cancelling an order, unless a similar charge would also apply to us for that cancellation.

8. Intellectual Property Rights

All content on this Website — including course videos, written material, templates, frameworks, graphics, logos, and the SocialKind Academy brand name — is the intellectual property of SocialKind Academy or its licensors, and is protected under applicable copyright and trademark laws. You may not copy, reproduce, resell, distribute, publicly share, or create derivative works from our content without our prior written permission.

9. User Conduct

When using our Website or courses, you agree not to:
Share your account access or course materials with anyone who has not purchased them
Record, reproduce, or redistribute course content for commercial or non-commercial purposes
Use the Website for any unlawful, fraudulent, or harmful purpose
Attempt to gain unauthorized access to our systems, other users’ accounts, or data

12. Limitation of Liability

To the fullest extent permitted by applicable law, SocialKind Academy, its founder, employees, and affiliates shall not be liable for any indirect, incidental, consequential, or special damages arising out of your use of the Website, courses, or Physical Products, including but not limited to loss of profits, revenue, or business opportunities.

13. Force Majeure

We shall not be held liable for any delay or failure in performance (including delayed delivery of Physical Products or delayed access to course content) resulting from causes beyond our reasonable control, including but not limited to natural disasters, fire, flood, strikes, riots, war, epidemic, government action, internet or power outages, or failures of third-party service providers such as our payment gateway, hosting, or courier partners.

14. Your Statutory Rights

Nothing in these Terms is intended to limit or exclude any rights you are entitled to under the Consumer Protection Act, 2019, or any other applicable consumer protection law in India. Where any provision of these Terms conflicts with a mandatory statutory right, your statutory right shall prevail.

15. Termination

We reserve the right to suspend or terminate your account or access to any course, without prior notice, if you violate these Terms, engage in fraudulent activity, or misuse our platform. You may also close your account at any time by contacting us

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms, the Website, or our courses shall be subject to the exclusive jurisdiction of the courts at South 24 Parganas (Alipore), West Bengal, India.
